Terms & Conditions
These terms govern the use of the Ashvane website and the engagement of our legal services. We encourage you to read them carefully and contact us if anything requires clarification.
Last updated: 1 January 2025
This document sets out the terms under which Ashvane provides legal services and operates its website. It does not constitute legal advice. If you have questions about these terms, please contact us before proceeding.
1. Acceptance of Terms
By accessing this website or engaging the services of Ashvane, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, we respectfully ask that you refrain from using this website or engaging our services.
These terms apply to all visitors, clients, and users of the Ashvane website located at ashvanea.biz, as well as to all individuals and entities who engage Ashvane in a professional capacity.
2. Services Offered
Ashvane is a legal practice registered and operating in Malaysia. We offer legal advisory and representation services in the following areas:
- Syariah Law Counsel — including family law, inheritance (faraid), and financial matters governed by Syariah law in Malaysia
- Environmental and Sustainability Law — including environmental impact assessment compliance, waste management regulations, and emissions reporting
- Alternative Dispute Resolution — including mediation, arbitration, and conciliation proceedings
The information provided on this website is intended for general informational purposes only and does not constitute legal advice. An engagement agreement must be executed before a formal legal relationship is established between you and Ashvane.
3. Engagement of Services
A formal engagement between Ashvane and a client is established only upon the execution of a written engagement letter or retainer agreement. Contact made through this website, by telephone, or by email does not in itself constitute a legal engagement.
Prior to commencing any legal work, Ashvane will:
- Confirm the scope of the matter in writing
- Communicate the applicable fees and estimated costs
- Obtain any necessary client due diligence documentation as required under Malaysian law
- Issue an engagement letter setting out the terms of the retainer
Work will commence only once the engagement letter has been signed by the client and any required initial payment has been received.
3.1 Conflict of Interest
Before accepting any engagement, Ashvane will conduct a conflict of interest check. If a conflict is identified, we will inform you promptly and, where appropriate, suggest alternative options.
3.2 Scope Limitations
Each engagement is limited to the specific matter described in the engagement letter. Ashvane will not be obligated to advise on matters outside the agreed scope without a separate engagement or written amendment.
4. Fees and Payment
Ashvane's fees are discussed transparently before any work begins. Our fee structure may include fixed fees, hourly rates, or a combination of both, depending on the nature of the matter.
4.1 Fee Communication
Fee estimates are provided in the engagement letter. Where the scope of work changes materially, we will communicate revised estimates before proceeding.
4.2 Disbursements
In addition to professional fees, clients may be responsible for disbursements — these are out-of-pocket expenses incurred on your behalf, such as court filing fees, translation costs, or third-party report fees. These will be communicated in advance wherever possible.
4.3 Payment Terms
Invoices are payable within fourteen (14) days of issue unless otherwise agreed in writing. Ashvane reserves the right to suspend work on a matter where invoices remain unpaid beyond agreed terms, after reasonable written notice to the client.
4.4 Currency
All fees and charges are denominated in Malaysian Ringgit (MYR) unless expressly agreed otherwise.
5. Client Obligations
Clients engaging Ashvane are expected to:
- Provide accurate, complete, and timely information relevant to the matter
- Inform Ashvane of any change in circumstances that may affect the matter
- Not withhold information that could be material to the legal advice provided
- Comply with all relevant Malaysian laws and regulations
- Respond to Ashvane's communications in a reasonably timely manner
Ashvane's ability to provide effective legal assistance is dependent on the accuracy and completeness of information provided by clients. We cannot be held responsible for advice that is based on incomplete or inaccurate information supplied by the client.
6. Confidentiality
Ashvane treats all client communications and matters with strict confidentiality, in accordance with the duties imposed by Malaysian professional legal standards and applicable law. Information shared with us will not be disclosed to third parties without your consent, except where required by law or court order.
This obligation of confidentiality survives the conclusion of the engagement and applies to all members of the Ashvane team and any authorised third parties engaged to assist on your matter.
7. Intellectual Property
All content on this website — including text, design, structure, graphics, and documentation — is the intellectual property of Ashvane or its licensors. Nothing on this website grants any licence to reproduce, distribute, or create derivative works from this content without prior written permission from Ashvane.
Legal opinions, memoranda, and documents prepared by Ashvane for a specific engagement are prepared for the client's use in that engagement. They may not be relied upon by third parties or reproduced for purposes beyond the original engagement without Ashvane's written consent.
8. Limitation of Liability
Ashvane's liability to clients is limited to the scope of the specific engagement for which services are rendered, and is subject to the terms of the engagement letter.
Ashvane shall not be liable for any indirect, consequential, incidental, or special damages arising from the provision of legal services, including but not limited to loss of business, loss of profit, or any other economic loss, except where such liability cannot be excluded by law.

10. Termination of Engagement
Either party may terminate a legal engagement by providing written notice. The terms for termination will be specified in the individual engagement letter.
Upon termination, the client will be responsible for fees incurred up to the date of termination. Ashvane will return any original documents belonging to the client in a reasonable timeframe, subject to any outstanding fees being settled.
Ashvane reserves the right to withdraw from an engagement where it would be professionally inappropriate to continue, including where the client has provided materially misleading information, or where continuing would compromise our professional obligations.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or from the provision of legal services by Ashvane shall be subject to the exclusive jurisdiction of the courts of Malaysia.
12. Amendments to These Terms
Ashvane reserves the right to update or amend these Terms and Conditions from time to time. Changes will be reflected on this page with an updated date. Continued use of this website following such changes constitutes acceptance of the revised terms.
For active engagements, material changes to terms will be communicated directly to affected clients in writing.
